I (Florian Wesch, currently the sole proprietor of info-beamer.com) would like to encourage you to carefully read these Terms of Service before using info-beamer.com ("the Site" or "the Service") operated by me (referred to as "us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of info-beamer.com.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions.

Account Terms

You must be at least 18 years or older to use the Service.

You may not have more than one account at a time. If you want to use multiple Accounts, please contact us.

Payments and Refunds

To buy licences for the info-beamer pi Signage Player or to use the info-beamer.com managed service you have to use a valid credit card in the Shop.

The Service is billed in advance. Buying info-beamer.com Credit will charge your info-beamer.com Account. Buying info-beamer pi licenses will allow you to download the info-beamer pi Software.

Payments are non-refundable.

Payments are made in Euro.

The Service is charging your info-beamer.com Account each day depending on your current usage. Insufficient Credits will disable your devices temporary. If you fail to add Credits to your account within 7 days the Service will remove all your content and reset all your registered Devices. We do not accept any liability for such loss.

Make sure you receive Mails sent by info-beamer.com. They will warn you when your Credit is getting low. Make sure you add Credits to your Account before your Devices get disabled. Disabled Devices will show a black screen.

Cancellation

You can close your Account any time. Doing so will reset all your Devices and remove all your stored content. There will be no refund for info-beamer.com Credit stored in your Account.

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you.

Copyright

You may not reverse engineer the info-beamer pi Software or the provided info-beamer.com Software. The provided info-beamer.com Software may not be used outside the info-beamer.com Service.

If you are interested in building your own Content Distribution System based on the info-beamer.com technology, feel free to contact us.

Ownership and Content

You retain all rights, title and interest, including all related intellectual property rights, to all information, brand marks, and content stored by you within info-beamer.com.

We reserve the right to monitor your content and to remove or disable content that we, in our sole discretion, determine to be illegal, harmful, offensive, creating liability for info-beamer.com or its service providers, or otherwise in violation of this Agreement or info-beamer.com operating policies.

Our Site may contain links to third-party sites that are not owned or controlled by info-beamer.com.

info-beamer.com has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit. If you decide to leave our Site and access these third-party linked sites, you do so at your own risk.

Limitation of Liability

In no event shall info-beamer.com be liable in contract, tort, strict liability, warranty or otherwise, for any special, incidental or consequential damages, such as, but not limited to, delay, disruption, loss of product, loss of anticipated profits or revenue, loss of use of the equipment or system, non-operation or increased expense of operation of other equipment or systems, cost of capital, or cost of purchase or replacement equipment systems or power.

We try to do our best. But we cannot promise to be perfect. So we're not liable if anything goes wrong. Please contact us if you think there's anything that's causing you problems. We'll hopefully figure a way out.

Governing Law

This Agreement (and any futher rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the German Law.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site and discontinue any use of the Site immediately.
